The Court of Appeals for the Second Circuit ruled in the manner recommended by Professor Terry Kogan in an amicus brief that he filed in The Andy Warhol Foundation for The Visual Arts, Inc. v. Lynn Goldsmith, et al. (2^nd 2021). According to Professor Kogan, the decision represents “a major win for photographers, whose work has been seriously devalued over the past years.”
